Fard for Gift Deed — All Punjab

Gifting Property? You’ll Need a Fard First.

Whether it’s a father gifting a house to his son or a husband transferring a plot to his wife — every gift deed guide starts with the same step one: check the land record. That means a fard. We start your case online with free guidance — then you visit our office once, because the deed signing and registration legally need your physical presence (or your authorized agent’s).

Worth Knowing

Zubani Hiba Is Dead — Registered Deed Is Now Mandatory

Since January 2026, Punjab does not recognise oral land transfers at all — no sale, no exchange, and no gift without a registered deed. A mutation alone can’t prove an oral gift either (the Lahore High Court said so again in October 2026). So the safe route is the written one: fard first, then a gift deed on e-stamp paper, registered with the Sub-Registrar within four months, then mutation at the ARC. The fard is step one — and it’s our part.

The Document

What Is a Fard for Gift Deed?

It’s the fard-e-malkiat showing the giver as the recorded owner — proof they actually own what they’re gifting, and that no loan or court order sits on it. No deed writer will draft your gift deed without it, and the Sub-Registrar won’t register it. People call it the hiba fard, fard e hiba, gift deed fard or property gift fard — different names, same paper, and it’s the one we get issued for you.

Where you’ll need it

  • Gift deed (hiba) between family members
  • Parents gifting a house or plot to children
  • Transfer between spouses
  • Any gift that ends in mutation at the ARC

What it proves

  • The donor’s name as the recorded owner
  • The khewat, khatoni and khasra numbers
  • Exact area and location of the property
  • That the record is current and QR-verified

How It Works

From Fard to Registered Gift — 4 Steps

Guidance is online and free — but the process itself needs one physical visit to our office. The law requires your presence (or your authorized agent’s) for signing and biometric verification.

1

Message us on WhatsApp

Send the donor’s CNIC and whatever property details you have — an old fard, khewat number, or just the address. We check the record is clean. This first step is fully online — guidance and record checking, free.

2

We get the fard issued

We trace the record in PLRA and get the QR-coded fard in the donor’s name — usually within hours.

3

Deed drafted & registered

The gift deed is written on e-stamp paper, signed by the donor, accepted by the donee, attested by two witnesses — then registered with the Sub-Registrar within four months of signing. You — or your authorized agent — must be physically present for the signing and biometric verification; this part can’t be done online. We prepare everything and accompany the process.

4

Mutation at the ARC

The registered deed goes to the Arazi Record Centre and the record changes to the donee’s name. We support the filing and follow-up.

Who This Is For

Every Kind of Family Gift, Covered

The hiba fard doesn’t change — only the relationship does.

Parents to Children

The most common gift of all. Father to son, mother to daughter — the fard confirms the parent’s ownership before the deed is drafted.

hiba fard

Between Spouses

Husband to wife or wife to husband. Note: family gifts get no stamp-duty discount — urban property is still 2%. We’ll tell you the exact cost upfront.

fard e hiba

Grandparents to Grandchildren

Skipping a generation is common — and exactly the kind of gift other heirs challenge later. A registered deed on a clean fard is your protection.

gift deed fard

Between Siblings

Brother to brother, sister to sister. Same 2% urban / 1% other-area stamp duty — the donee (receiver) pays it.

property gift fard

Agricultural Land

Farm land and village plots gifted within the family. Khewat and khasra numbers help us trace the record fast.

fard for hiba

Urban House or Plot

City property in PLRA-computerized areas. (DHA and private societies have their own transfer offices — ask us and we’ll tell you honestly which route applies.)

Requirements

What a Gift Deed Needs

The full checklist, so nothing stalls:

  • CNIC copies of donor and donee (originals for verification)
  • Fard-e-malkiat — the donor’s ownership proof (this is our part)
  • Gift deed drafted on e-stamp paper of proper value
  • Two witnesses with valid CNICs
  • Passport-size photographs of donor and donee
  • Property tax receipts, if the Sub-Registrar asks

Good to know

Stamp duty on a gift deed is 2% of the property value in urban areas, 1% elsewhere — paid by the person receiving the gift — plus a Rs 500–1,000 registration fee. The value comes from the district valuation table, not whatever price you write. And remember the three ingredients of a valid hiba: a clear offer, acceptance, and actual delivery of possession — paperwork records the gift, it doesn’t replace them.

One honest note: the fard and all guidance happen online, but the deed registration needs you physically at the office — or an authorized agent on your behalf. There’s no fully-online shortcut for this, and anyone promising one isn’t telling the truth.

FAQ

Questions Families Actually Ask

+What is a hiba fard, in simple words?

It’s the fard-e-malkiat showing the giver (donor) as the owner of the property being gifted. Every gift deed process starts with it — it proves the donor actually owns what they’re giving, free of loans or court orders.

+Is a zubani (oral) gift still valid in Punjab?

Under Muslim law the three ingredients — offer, acceptance, possession — are what make a hiba valid. But since January 2026, Punjab won’t transfer land on an oral claim: no registered deed, no mutation. And courts have repeated that a mutation alone can’t prove an oral gift. Get it in writing and registered.

+What are the three conditions of a valid hiba?

One: the giver clearly offers the gift. Two: the receiver accepts it. Three: possession is actually delivered — keys handed over, moved in, rent received. Miss any one of the three and the gift can be challenged, paperwork or not.

+What’s the stamp duty on a gift deed?

2% of the property value in urban areas, 1% in other areas — worked out from the district valuation table, not your written price. The receiver (donee) pays it, plus Rs 500–1,000 registration fee. Family gifts get no discount on the rate.

+Can I gift property to a minor child?

Yes — but the deed must say a legal guardian will hold the property in trust until the child turns eighteen. We’ll make sure the deed writer includes it.

+Can a gift be taken back later?

Before possession is delivered, yes — a hiba can be revoked. After a registered deed and handed-over possession, taking it back is extremely difficult. That’s exactly why doing it properly the first time matters.

+How long does the fard take?

Usually just a few hours after you send the details on WhatsApp. The deed registration depends on the Sub-Registrar’s schedule — we’ll give you a straight answer on both before we start.

+What will it cost me?

Official PLRA fee plus our service charge for the fard — both told to you upfront on WhatsApp, nothing hidden, and you get the official receipt. (Stamp duty and registration fee are separate — those go to the government on the deed.)
